The agreement between you and Kinote Technology Inc for your use of Kinward.
These terms are a contract between you and Kinote Technology Inc (“Kinote”, “we”, “us”), the company that makes the Kinward application and service. By creating an account or using Kinward, you agree to them. If you don't agree, don't use Kinward.
Kinward screens incoming phone calls and text messages to an enrolled phone for signs of a scam, and alerts the family caregivers on the account. Depending on your setup it may also flag suspicious bank activity, surface upcoming medical appointments, and maintain a blocklist.
Kinward is not an emergency service. Do not rely on it to reach emergency responders. Always call your local emergency number directly.
Kinward is not advice. Nothing it produces is medical, legal, or financial advice. Verdicts are automated judgments about the likelihood of a scam, and they can be wrong in both directions — a real scam can slip through, and a legitimate call can be flagged. You remain responsible for your own decisions.
You must be at least 18 and able to enter a contract. Kinward is offered in the United States.
An account belongs to a family. The owner controls the subscription and membership; members can see the family's screening activity. Everyone with access to a family can see sensitive information about the loved one, so add members deliberately. You are responsible for activity under your sign-in and for keeping it secure.
Screening only works with the knowledge and agreement of the person whose phone is enrolled. By enrolling a phone you confirm that the person who uses it understands their calls and messages will be screened and agrees to it. Do not use Kinward to monitor anyone covertly. We may suspend accounts we believe are being used to surveil someone without their consent.
Setting up screening asks the enrolled phone to forward incoming calls to a Kinward number through the
carrier. You can turn this off at any time by dialling ##21# from that phone. If you cancel
or delete your account while forwarding is still on, calls to that phone may keep routing to Kinward
until you switch forwarding off — so switch it off before you leave. Carrier charges for call forwarding,
if any, are between you and your carrier.
Kinward analyzes call audio while a call is happening and never records or stores it. We designed it this way deliberately, including for two-party-consent jurisdictions. See our Privacy Policy.
If you enroll a phone, we may send it transactional service notifications about screening. Message and
data rates may apply and message frequency varies. Reply STOP to opt out or
HELP for help. Details are in our Privacy Policy.
Paid plans renew automatically for the period you selected until you cancel. Cancel any time from your account or the app store you subscribed through; cancellation takes effect at the end of the current period, and unless the law says otherwise we don't refund the period already paid for. If you subscribed through Apple or Google, their billing and refund rules apply. We may change prices with notice before your next renewal.
Bank and health-record connections are optional and are made through third-party providers. Connecting one means agreeing to that provider's terms as well. You can disconnect at any time, which removes the associated data from Kinward.
Kinward, its software, and its branding belong to Kinote. We grant you a personal, non-transferable, revocable licence to use the app for its intended purpose. Your own content stays yours; you grant us the licence needed to operate the service for you.
We work to keep Kinward running, but we don't promise uninterrupted service. Screening depends on carriers, networks, devices, and third-party providers that we don't control, and any of them can fail. We may change or discontinue features, and we'll give reasonable notice of material changes.
To the fullest extent the law allows, Kinward is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Kinward will detect every scam or that it will never flag a legitimate contact.
To the fullest extent the law allows, neither Kinote nor its suppliers is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of Kinward. Our total liability for any claim relating to Kinward is limited to the amount you paid us in the twelve months before the claim arose. Some jurisdictions don't allow these limits, in which case they apply only as far as permitted.
You'll defend and indemnify Kinote against claims arising from your misuse of Kinward, your breach of these terms, or your enrollment of a phone without the user's consent.
You can stop using Kinward and delete your account at any time — see how to delete your account. We may suspend or terminate an account that breaches these terms or that we reasonably believe is being used to harm someone. Remember to turn off call forwarding on any enrolled phone before you go.
We may update these terms. If a change is material, we'll update the effective date and notify account owners in the app or by email before it takes effect. Continuing to use Kinward after that means you accept the new terms.
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Disputes will be heard in the state or federal courts located in Delaware, and you and we consent to that jurisdiction. Nothing here removes any right you have to bring a claim in your local small-claims court or under mandatory consumer-protection law where you live.
